Contract regarding the publication of digital documents on TUprints, the Open Access Repository of Technical University of Darmstadt

§ 1 Subject matter of the contract

  1. The Author / Publisher authorises the Library to publish and offer the stated work(s) in digital format on the Internet for fair use based on the conditions stated below.
  2. The publishing takes place under the licence chosen by the author/editor(1).

§ 2 Granting of rights by and duties of the Author(s) / Publisher(s)

  1. The Author / Publisher grants the Library a perpetual, worldwide, non-exclusive licence for electronic publishing.
  2. The Author / Publisher confirms to be the copyright owner of this work / these works and not to have entered contrary agreements yet.
  3. The Author / Publisher declares that the publication of the work does not violate any third-party rights and indemnifies the Library against any third-party claims.
  4. The consent to publish has been obtained of all other Authors involved.
  5. The Author / Publisher authorises the Library to copy and save the work on its own servers and to make it available to the public via the Internet.
  6. The Author / Publisher authorises the Library to share the work with the German National Library and with library services operated by partners which both are likewise granted the right of permanent storage.
  7. The Author / Publisher authorises the Library to freely distribute pertinent meta data to databases or directories.
  8. The Author / Publisher authorises the Library to migrate the work to other formats should this become necessary to enable scientific use or archiving.

§ 3 Duties and services of the Library

  1. The Library provides all current and former affiliates and members of Technical University of Darmstadt with the general organisational and technical environment for publishing scientific documents electronically. Affiliates and members are defined in accordance with the Hessisches Hochschulgesetz (HHG – Universities and Higher Education Act of the State of Hesse) .
  2. The Library is responsible for the publishing, storing, cataloguing, archiving and distributing of published electronic documents. Every electronic document receives a persistent digital identifier (DOI, URN). The Library guarantees to manage and maintain DOIs and URNs. The Library is not liable for technical interruptions of the Internet or while exchanging data.
  3. The Library guarantees the long-term archiving (i.e. digital preservation) of the electronic documents. These documents may be converted to other technical formats as necessary for archiving or accessibility.
  4. The Library provides templates based on the TU Darmstadt corporate design for publishing in LaTeX, Word, Open Document Format and PowerPoint, all of which are recommended deposit formats.
  5. The Library makes all electronic publications available for scientific use in PDF/A and XML formats. All XML files are transferred to a custom target format developed by ULB based on the Text Encoding Initiative (TEI).
  6. Electronic publishing is free of charge.
  7. The data privacy protection declaration of TU Darmstadt and the downstream regulations of the Library regarding data privacy protection apply.

  5. Die Volltexte dürfen nach § 60d UrhG als Textkorpus von einem abgegrenzten Personenkreis für Methoden des Text- und Data Mining genutzt werden. Das Korpus ist nach Abschluss der Forschungsarbeit von den eigenen Datenträgern zu löschen.
